RESOLUTION #07-2005-08

RESOLUTION OF THE CADDO NATION COUNCIL APPROVING THE REQUEST TO THE ANADARKO AGENCY, ANADARKO, OK OF THE WITHDRAWAL OF ALL ANNUAL ACCRUED INTEREST THROUGH 2005 FROM ITS BURIAL ACCOUNT APPROPRIATION 9031, ACTIVITY 2617

WHEREAS: The Caddo Nation is a federally recognized tribe, governed by a Constitution pursuant to the Oklahoma Indian Welfare Act of 1936, (49 Stat. 1967), and

WHEREAS: under the revised Caddo Nation Constitution and By-Laws adopted by the Caddo Nation on June 26, 1976, and recognized by the Secretary of the Interior, the Tribal Council of the Caddo Nation has certain powers, and

WHEREAS: under Article V, Section 2, part 'k' of the Tribal Constitution, the Caddo Nation Council is empowered to exercise the responsibility, subject to any restrictions in federal or state law, 'to appropriate and expend available tribal funds for the benefit of the tribe or any of its operations', and

WHEREAS: the Caddo Nation Burial Account accrues annual interest which is appropriated at the end of December each year, and

WHEREAS: the Caddo Nation assists families with burial assistance from interest money accrued annually on the burial account.

NOW THEREFORE BE IT RESOLVED: that the Caddo Nation Council approved the withdrawal of all accrued annual interest from the date of the last withdrawal to the present from its Burial Account #### in the amount of $26,167


CERTIFICATION

We, the undersigned Chairman and Acting Secretary of the Caddo Nation Council of Oklahoma, hereby certify that the Caddo Nation Council is composed of 8 members, and with a quorum being composed of 5 members, of whom 7 were present at a meeting thereof duly and specially called, and convened and held on the 28 day of July, 2005 at the Caddo Nation complex in Binger, Oklahoma, and that the foregoing resolution was duly adopted by an affirmative vote of 6 FOR; with 0 OPPOSING; and 0 ABSTAINING. The Chairman is not required to vote except in the case of a tie.
